Income Tax Appeal Consultant in Kancheepuram
We draft and argue income-tax appeals for taxpayers in Kancheepuram: first appeals to the Commissioner (Appeals) or Joint Commissioner (Appeals), further appeals to the Income Tax Appellate Tribunal, and stay of demand while the appeal is pending. CIT(A) appeals are faceless and filed online; we prepare the grounds, statement of facts, paper book and written submissions. This page covers the law that applies and links to every Kancheepuram area we serve.
Kancheepuram appeals we handle are mostly about traders' cash deposits and estimated profits.

How do I file an appeal to the CIT(A), and by when?
An appeal against an assessment, penalty or other appealable order goes to the Commissioner (Appeals) or the Joint Commissioner (Appeals) within 30 days of service of the demand notice or the order (section 358 of the Income-tax Act, 2025). For years governed by the Income-tax Act, 1961, the appeal is filed in Form 35 under that Act. Appeals are filed on the e-filing portal and decided under the faceless appeal scheme; late appeals can be admitted if there was sufficient cause.
Can recovery of the demand be stayed?
Yes. While the appeal is pending, you can ask the Assessing Officer for a stay of the disputed demand. Under CBDT's guidelines a stay is generally granted on payment of 20% of the disputed demand, and the officer or higher authorities can accept a lower amount where the case is strong or the assessment is high-pitched. Refunds should not be adjusted against a stayed demand beyond these limits.
What grounds succeed most often?
Common winning grounds are: reassessment notices issued beyond the time limit (three years, or five years only where escaped income is ₹50 lakh or more) or without proper procedure; additions for unexplained cash or credits where the source is documented; penalties for under-reporting or misreporting without the required findings; and disallowances made without giving you a hearing. We support each ground with documents and decisions of the Madras High Court and the ITAT.
What happens after the CIT(A)?
If the CIT(A) order goes against you, the next appeal lies to the Income Tax Appellate Tribunal within two months, and from there to the High Court on a substantial question of law. We prepare the paper book, written submissions and compilation of case law, and argue the appeal before the Tribunal.

Frequently Asked Questions
What is the time limit for an income-tax appeal to the CIT(A)?
Thirty days from service of the demand notice or the order, under section 358 of the Income-tax Act, 2025. For years governed by the 1961 Act, its appeal provisions and Form 35 apply. Late appeals can be admitted if you show sufficient cause.
Do I have to pay the demand before appealing?
The tax due on the income you returned must be paid before the appeal is admitted. The disputed demand need not be paid in full; you can seek a stay, which CBDT's guidelines generally allow on payment of 20% of the disputed amount.
