How do I file an appeal to the CIT(A), and by when?
An appeal against an assessment, penalty or other appealable order goes to the Commissioner (Appeals) or the Joint Commissioner (Appeals) within 30 days of service of the demand notice or the order (section 358 of the Income-tax Act, 2025). For years governed by the Income-tax Act, 1961, the appeal is filed in Form 35 under that Act. Appeals are filed on the e-filing portal and decided under the faceless appeal scheme; late appeals can be admitted if there was sufficient cause.
Can recovery of the demand be stayed?
Yes. While the appeal is pending, you can ask the Assessing Officer for a stay of the disputed demand. Under CBDT's guidelines a stay is generally granted on payment of 20% of the disputed demand, and the officer or higher authorities can accept a lower amount where the case is strong or the assessment is high-pitched. Refunds should not be adjusted against a stayed demand beyond these limits.
